On March 15, 2020, the Executive has approved the Supreme Decree No. 044-2020-PCM, a resolution that declares National State of Emergency for the serious circumstances that affect the life of the Nation as a result of the COVID-19 outbreak.
In order to reinforce the objectives outlined under the State of National Emergency, a series of additional complementary measures were issued. Below we present a list of the most relevant regulations with financial impact.

Urgency Decree No. 029-2020, published on March 20, 2020: “Urgency decree whereby they issue complementary measures aimed at financing micro and small businesses and other measures to reduce the impact of COVID-19 on the Peruvian economy ”.

The Superintendence of the Securities Market (SMV) decided to extend various obligations related to its market.

Measures:

  • Until June 30, 2020, the deadline for submitting audited individual or separate financial information was extended, as well as the annual report for the year 2019. This extension applies to companies issuing securities registered in the RPMV (Private Stock Market Registry), legal entities registered in the RPMV, the Collective Funds Management Companies and the autonomous estates that they manage.
  • The obligation to report the annual audited consolidated financial statements of the parent of the aforementioned persons is extended to July 31, 2020, for the year 2019, and, until August 31, 2020, the annual consolidated financial information of the parents by fiscal year 2019.
  • The intermediate information as of March 31, 2020, is extended until July 31, 2020. Likewise, it is expected that until August 15, 2020, the consolidated financial statements of the matrix of supervised subjects indicated above may be reported.
  • The risk classification reports prepared by the risk classification companies based on the audited annual financial information as of December 31, 2019 will be presented until August 31, 2020.
  • The information on the economic group will expire on September 30, 2020. It should be noted that the significant events must be sent via the MVNET System on a regular basis.
  • All the information not included in the aforementioned Resolution and which expires during the State of National Emergency is suspended until the SMV establishes new delivery terms.

Measures:

  • The remuneration of the worker corresponding to the month of April 2020 will not be affected with the withholding and payment of the components of the obligatory contribution of 10% and the commission on the flow, suffering only the discount of the amount corresponding to the Collective Disability and Survival Insurance of the SPP, so that coverage is not affected.
  • The private sector employer that meets the requirements will receive an exceptional subsidy for each worker that generates fifth category incomes as long as they do not exceed S/ 1,500.

  • A monetary subsidy of S/ 380 will be granted in favor of vulnerable households with independent workers, according to the targeting carried out by the Ministry of Labor and Employment Promotion.

  • Affiliates who meet this requirement can submit their request to their AFP (Private Funds Administrator) remotely or by using the channels established by each AFP. The AFPs must make the payment of the requested amount available in April.
  • The provisions of this rule will be in force until December 31, 2020.

  • The operating procedure has been established for the extraordinary withdrawal of pension funds in the Private Pension System (SPP), provided by Emergency Decree No. 034-2020.
  • It is applicable to all affiliates who, having resources in their Individual Mandatory Contribution Capitalization Account (CIC) under the administration of an AFP, as of March 31, 2020 do not register accreditation of mandatory contributions in the respective CIC for the months whose accruals correspond between September 2019 and February 2020.
  • Affiliates can enter their extraordinary withdrawal request under the channels and formats enabled by the AFPs until April 27, 2020.
  • Once the request is received, the AFP must assess compliance with the requirements and, if appropriate, communicate this to the affiliate through the authorized channels and make the disbursement within a period not exceeding three (3) business days.
  • In the event that it is not appropriate, the AFP must inform the affiliate within a period of no more than five (5) business days, through the authorized channels, recording the fact.
  • Payments are made in an amount of up to S/ 2,000 in April. In case the CIC balance of an affiliate is less, the AFP makes the funds available in full to the affiliate for a withdrawal request, in the same month of April.
  • The AFP is responsible for arranging the appropriate means in order to make the payment effective, given the emergency conditions. For this purpose, the AFPs may sign agreements with entities of the financial system or others that facilitate payment.

Measures:

  • Rules are issued on the continuity of the provision of basic public services for the vulnerable population: electric power, natural gas and telecommunications (fractionation of the payment of pending bills).
  • Likewise, complementary measures are issued for the delivery of the subsidy for the payment of private sector employers: I) The Interbank Account Code (CCI) communicated by the employer must correspond to a valid and active account in national currency, it cannot be a Compensation for Time of Service account; II) The account reported by the employer must belong to an entity of the national financial system that participates in the interbank transfer system via the Electronic Clearing House (CCE); III) The tax debts enforceable or that are in bankruptcy process that make it impossible to qualify for the subsidy are those debts administered by SUNAT; IV) The period of seven working days that SUNAT has for the processing of the January PLAME is counted from April 6, 2020.
  • It also provides for the transfer of items in the public sector budget for the year 2020 from the resources of the Contingency Reserve, in favor of the Ministry of Foreign Trade and Tourism, to finance contracts for the acquisition of goods and services for temporary quarantine accommodation in the context of the emergency due to COVID-19 and food for Peruvians returning from abroad.
  • As an exception, the immediate provision by the Ministry of Health of the medical equipment specified in the Annex is approved, whether they are owned by the State or are included in contracts in execution signed by public entities of the three levels of government, to be assigned to the attention of people affected by the COVID-19 virus in the national territory.
  • Complementary provisions on the extraordinary withdrawal of the Pension Fund from the Private Pension System are approved within the framework of Emergency Decree No. 034-2020, among others: I) The companies of the financial system send, at the request of the AFPs, the CCI of the affiliates who have requested the extraordinary withdrawal of up to S / 2,000 from their Individual Capitalization Account (CIC); II) The delivery of the CCI or other information necessary to make the transfer are exempt from the scope of bank secrecy. III) The amount of the extraordinary withdrawal maintains its intangible nature vis-à-vis third parties, so it is not subject to compensation, collateral, precautionary measure or measure of any nature that is intended to affect its free availability.
  • This Emergency Decree will be in force until December 31, 2020.

Measures:

  • The “REACTIVA PERU” Program is created, which aims to guarantee the replacement of working capital funds of companies that face payments and short-term obligations with their workers and suppliers of goods and services, through a mechanism that grants the guarantee of the National Government to the credits in national currency that are placed by the Companies of the Financial System.
  • The guarantee only covers credits in national currency that are placed by the Companies of the Financial System, from the effective date of the Operating Regulations of the REACTIVA PERU Program and until June 30, 2020, in order to ensure continuity in the chain of payments in the national economy. This period can be extended by means of a Supreme Decree endorsed by the Minister of Economy and Finance.
  • The guarantee granted by the Government covers the maximum amount that is less than the amount equivalent to three (3) times the company's annual contribution to EsSalud in 2019 and the amount equivalent to one (1) month of monthly average sales. of the year 2019, according to SUNAT records.
  • The Government will guarantee up to a maximum of 98% of the credits that companies request from banks to cover payments and short-term obligations with their workers and suppliers of goods and services.
  • The total amount of the credits that are guaranteed through the REACTIVA PERU Program per debtor company does not exceed S/ 10,000,000.
  • The credits to be guaranteed cannot exceed thirty-six (36) months, which includes a grace period of interest and principal of up to twelve (12) months.

  • The regulation empowers the Banco de la Nación to grant credits to natural or legal persons who operate their correspondent ATMs at the national level, in order to guarantee the availability of resources necessary to permanently attend to the operations of a correspondent ATM to effects of granting the monetary subsidy, in order to reduce the influx of public in the offices of said bank.
  • The subsidy may be charged up to 30 calendar days after the end of the health emergency. To access the subsidy payment, users must enter the web portal yomequedoencasa.pe.
  • The emergency decree is valid until December 31, 2020.

Urgency Decree No. 053 -2020, published on May 5, 2020: “Urgency Decree that grants an extraordinary bonus to the personnel of the National Penitentiary Institute, the National Program of Youth Centers, the personnel of the Ministry of Defense and the personnel of the Ministry of the Interior, for carrying out high-risk actions in the face of the Emergency produced by COVID-19, and dictates other provisions. ”

  • Extraordinary measures are approved in economic matters, in order to grant an extraordinary bonus, for one time only, in favor of the staff of the National Program of Youth Centers and the National Penitentiary Institute, the staff of Officers, Technicians, Sub-Officers and the Military Service Barracks of the Armed Forces, and of the personnel of the National Police of Peru that provide services within the framework of the State of National Emergency and the National Health Emergency, due to the outbreak of COVID-19.
  • The monthly extraordinary bonus is S / 720.00 for the workers of the juvenile centers and penitentiary establishments that carry out effective, permanent and face-to-face work, food, security, health, accompaniment, monitoring, guidance and other essential functions for the operation of these establishments.

The beneficiaries will be only those who carry out work to support the PNP in actions related to the state of sanitary emergency and confinement; excluding trusted workers and those who perform administrative duties.
  • Although a bonus of S / 720.00 per month is contemplated for police personnel, this will only benefit those who carry out effective, permanent and face-to-face work in public spaces, within the framework of what is established by the state of sanitary emergency.
  • The rule has also provided, among other measures, for the suspension of the computation of start-up and processing deadlines for administrative procedures and procedures of any kind, including those regulated by laws and special provisions, established by Emergency Decree No .029-2020; for the term of 15 business days, counted from May 7, 2020.

    • The FAE MYPE guarantee only covers the guarantee percentage of the unpaid balance of the originally paid-up capital. The ESF or COOPAC must pay a commission for the reprogramming of the credit with the FAE MYPE guarantee equivalent to 0.06% of the unpaid balance, which can be transferred to the beneficiaries of the reprogramming. This commission must be paid only once at the time of confirmation by COFIDE and during the new grace period. It is specified that said commission is additional to the additional margin that the ESF or COOPAC can add to the interest of the rescheduled loan; Therefore, the commission for rescheduling does not consider a cost of credit rescheduling for the purposes of applying article 5 of Emergency Decree No. 029-2021, nor section (iii) of numeral 23.1. of article 23 of these regulations.

Measures:

  • The delivery of an extraordinary and one-time bonus of S / 1,500.00 is authorized for health personnel referred to in numeral 3.2 of article 3 of Legislative Decree No. 1153 and to health personnel hired under the Regime of Legislative Decree No. 1057 for providing health services and supporting care work.
